By accessing or using TailEZ, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, as well as our Privacy Policy. If you do not agree with any part of these terms, you must not use our service.

These terms apply to all users of the application, including both free and premium subscribers. Your continued use of TailEZ constitutes acceptance of any changes or updates to these terms.

TailEZ is a pet care organisation application designed to help users:

• Store and manage pet profiles and care records

• Track routines such as medications, feeding, journals, measurements, reminders, and related records

• Use features such as pathways, logs, and other care tools made available in the App

• Organise pet-related information in one place for personal household use

• Access free and premium features, depending on the version of the service in use

We strive to provide a reliable service, but we continuously improve and update the App, which may result in changes to features and functionality.

To use TailEZ's full features, you must create an account:

• Account Creation: You must provide a valid email address and create a secure password. You are responsible for maintaining the confidentiality of your account credentials.

• Account Security: You are solely responsible for all activities that occur under your account. Notify us immediately at hello@tailez.com if you suspect any unauthorised access or security breach.

• Accurate Information: You should ensure that any information you add to your account is accurate and kept reasonably up to date for your own use.

• Age Requirement: You must be at least 13 years old to use TailEZ. By creating an account, you confirm that you meet this age requirement.

• One Account Per User: You may only create and maintain one account per user. Multiple accounts for the same individual are not permitted.

You agree to use TailEZ in a lawful and responsible manner:

• Legal Compliance: You must comply with all applicable local, state, national, and international laws and regulations whilst using our service.

• Intended Purpose: Use TailEZ for its intended purpose of organising pet-related information and routines. Do not attempt to manipulate or falsify records for deceptive or unlawful purposes.

• Personal Use: Your account is for your personal use only. Do not share your login credentials or allow others to use your account without permission.

• Respectful Conduct: Do not use TailEZ to harass, abuse, or harm others, or to transmit any harmful, defamatory, or malicious content.

• Responsible Reliance: Use your own judgement when acting on information stored in the App, and seek professional advice where appropriate.

Whilst we strive for accuracy, please understand:

• User-Entered Data: Much of the information in TailEZ depends on what you enter or maintain. You are responsible for reviewing and verifying the accuracy of your records.

• No Guarantee: We do not guarantee that every reminder, record, pathway, journal, or other feature will always be error-free, complete, or suitable for every situation.

• Manual Corrections: You may edit or delete information that is inaccurate. We recommend reviewing important records regularly.

• Not Professional Advice: TailEZ does not provide veterinary, medical, legal, or financial advice. Consult an appropriate professional where necessary.

• Feature Availability: Some features may change, be updated, or be withdrawn over time as the service develops.

You must not engage in any of the following activities:

• Reverse Engineering: Do not attempt to reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the App.

• Circumvention: Do not bypass, disable, or interfere with security features or features that prevent or restrict use or copying of content.

• Automated Access: Do not use robots, scripts, or automated means to access the service without our express written permission.

• Data Mining: Do not extract, scrape, or harvest data from the service for unauthorised purposes.

• System Interference: Do not introduce viruses, malware, or any harmful code that may damage or disrupt our service or other users' experiences.

• Fraudulent Use: Do not use TailEZ for any fraudulent, deceptive, or illegal purposes, including falsifying records or misusing the service.

All intellectual property rights in TailEZ belong to us:

• Ownership: TailEZ, including its design, features, code, graphics, logos, and content, is protected by intellectual property laws.

• Limited Licence: We grant you a limited, non-exclusive, non-transferable, revocable licence to use TailEZ for personal, non-commercial purposes in accordance with these terms.

• Your Data: You retain ownership of the data you input into TailEZ. By using our service, you grant us a licence to store, process, and display this data to provide our services to you.

• Assets: 'TailEZ' logos and brand assets may not be used without our prior written permission.

• Feedback: If you provide feedback or suggestions about TailEZ, we may use them without any obligation to compensate you.

IMPORTANT - PLEASE READ CAREFULLY:

• 'AS IS' Service: TailEZ is provided 'as is' and 'as available' without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

• No Guarantee of Availability: We do not guarantee that TailEZ will be uninterrupted, timely, secure, or error-free. We may suspend or discontinue the service at any time without notice.

• Accuracy: We do not warrant the accuracy, completeness, or reliability of any data, content, reminders, records, or information provided through TailEZ.

• Third-Party Services: TailEZ may rely on third-party services such as Apple, Google, Supabase, Brevo, Resend, Postmark, Firebase, or other infrastructure and service providers. We are not responsible for failures or issues arising from those third-party services.

• Device Compatibility: We do not guarantee that TailEZ will be compatible with all devices or operating system versions.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• No Liability for Damages: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from:

- Your use or inability to use TailEZ - Any unauthorised access to or use of your data - Any errors, omissions, delays, or inaccuracies in records, reminders, or other information in the App - Any decision you make based on data from TailEZ (including care, veterinary, legal, or financial decisions)

• Maximum Liability: Our total liability to you for all claims arising from or related to TailEZ shall not exceed the amount you paid us in the 12 months preceding the claim, or £100, whichever is greater.

• Professional Reliance: You remain responsible for decisions concerning your pets' care and wellbeing. TailEZ is an organisational tool and not a substitute for professional advice.

• Third-Party and Service Consequences: We are not responsible for issues, losses, or consequences arising from outages, delivery failures, or limitations in third-party services used by TailEZ.

Either party may terminate this agreement:

• Your Right to Terminate: You may terminate your account at any time by deleting it within the App or by contacting us at hello@tailez.com. Upon deletion, all your data will be permanently removed from our servers, subject to any legal retention requirements.

• Our Right to Terminate: We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these terms or engaged in prohibited activities.

• Effect of Termination: Upon termination, your right to use TailEZ immediately ceases. Any provisions of these terms that by their nature should survive termination (including disclaimers, limitations of liability, and intellectual property provisions) shall continue to apply.

• No Refunds: If you have paid for premium features and we terminate your account for cause, you will not be entitled to a refund. If you voluntarily delete your account, refunds may be provided at our discretion or in accordance with the relevant app store's policies.

We may update these Terms and Conditions from time to time:

• Notification: We will notify you of significant changes by updating the 'Last Updated' date at the top of this document and, where appropriate, by sending you an email notification or in-app alert.

• Your Acceptance: Your continued use of TailEZ after changes to these terms constitutes your acceptance of the updated terms.

• Review Regularly: We encourage you to review these terms periodically to stay informed about your rights and obligations.

• Substantial Changes: If we make substantial changes that materially affect your rights, we will provide prominent notice and may require you to affirmatively accept the new terms before continuing to use TailEZ.

These terms are governed by applicable laws:

• Governing Law: These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law provisions.

• Dispute Resolution: Any disputes arising from these terms or your use of TailEZ should first be addressed by contacting us at hello@tailez.com. We will work in good faith to resolve any issues.

• Jurisdiction: You agree to submit to the exclusive jurisdiction of the courts of England and Wales for the resolution of any disputes.
